The Kaneshie District Court has dismissed the case
presented to it by lawyers for Assistant Commissioner of Police (ACP) Benjamin
Agordzo, challenging the court over its jurisdiction to handle the matter which
The court, presided over by Mrs Eleanor Kakra Bans Botchwey, described as unfounded the defence’s claim that the court lacked the jurisdiction to handle the matter.
In her ruling, Mrs Botwchwey said the District court is fully cloaked with the powers to deal with the case brought before it and directed the charge to be read to the suspect for committal proceedings to begin and fast track the process of prosecution against the suspect.
Defence team for ACP Agordzo, led by Martin Kpedu, had argued that the Lower Court lacked the authority to proceed with the case on the basis that the court lacks the authority to hear first-degree felony cases such as the one against ACP Agordzo.
Dr Agordzo has been charged with abetment to commit treason for his alleged involvement in the coup plot.
